Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Khodawanpur P.S. Case No. 28 of 2022 registered for the offence under Sections 302, 201, 120(b) and 34 of the Indian Penal Code.

The allegation against the petitioner is that he has killed the deceased because he has illicit relation with the wife of the petitioner and there is no direct evidence against the petitioner. The petitioner is in custody since 23.02.2023. Learned A.P.P. has vehemently opposed the prayer

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawanpur P.S. Case No. 28 of 2022.

The petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
