JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-08-2017 This criminal miscellaneous has been filed for modification of the order dated 03.03.2017 passed in Cr. Misc. No. 2763 of 2017, on the ground that the petitioner was released on provisional bail for three months and thereafter he filed completion certificate duly granted by the authority concerned but as there was some delay the learned court below did not confirm the bail granted to the petitioner and, as such, the said part of the order should be modified. The petitioner has already completed the work and completion certificate has already been granted vide Annexure-3.

In the fact and circumstances as stated above, the learned court below is directed to consider the completion certificate dated 16.06.2017 granted by District Program Officer, Banka, and shall confirm the bail granted to the petitioner within 15 (fifteen) days from the date of receipt/production of a copy of this order, failing which the bail granted to the petitioner shall be deemed to be cancelled.
