This is an application for grant of anticipatory bail in connection with Adhoura P.S. Case No. 5 of 2017 registered for the offence punishable under Sections 341, 323, 448, 354 and 379/504 of the Indian Penal Code.

The allegation against the petitioner is abusing the informant and snatching his gold chain when he had come to the informant to demand the outstanding dues on the head of labour charges.

The learned counsel for the petitioner submits that no injury whatsoever has been found and the allegation levelled against the petitioner is incorrect. It is further submitted that there is a delay of 14 days in lodging the present F.I.R., which is

Patna High Court Cr.Misc. No.9828 of 2018(2) dt.19-02-2018 2/2 fatal to the case of the prosecution. The petitioner is stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Adhoura P.S. Case No. 05 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
