The petitioner apprehends his arrest in Barsoi P.S. Case No. 86/2016, registered for the offences punishable under Section 307, 337, 353 and other sections of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that at the time of counting of vote of Panchayat election, the accused persons raised hue and cry and damaged the vehicle of the police.

Learned counsel for the petitioner submits that petitioner is of course named in the F.I.R., but no specific allegation is made against the petitioner. Ballot box was damaged and that is why the villagers became infuriated. Many co-accused persons have been granted anticipatory bail by different benches of this court.

No.45612 of 2016 (2) dt.24-11-2016 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner and many other accused persons have already been granted anticipatory bail, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Barsoi P.S. Case No. 86/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
