The petitioners apprehend their arrest in Khaira P.S. Case No. 160 of 2017 instituted for the offence under Sections 341, 323, 324, 307, 448 and 120(B)/34 of the Indian Penal Code. As per written report, there is allegation against the petitioner No. 1 of assaulting the informant with iron rod on his head causing bleeding injury. When the wife of the informant came to save him, she was assaulted by petitioner No. 2 with Barchhi (Bhala) causing bleeding injury in her hand. The counsel for the petitioners has submitted that informant entered into the house of petitioners and tried to outrage the modesty of wife of petitioner No. 1, for which, he has filed

Patna High Court Cr.Misc. No.37532 of 2017 (3) dt.25-08-2017 2/2 Complaint Case No. 1982 of 2017 on 24.6.2017. The counsel for the petitioner has also submitted that the instant case has been filed by the informant on 20.6.2017 just to save the skin. From the written report it appears that there is specific allegation against petitioners of brutally assaulting the informant and his wife on 20.6.2017. The Doctor has found lacerated wound on the head of the informant and patient was referred for C.T. Scan and the opinion was kept reserved. Wife of the informant also sustained lacerated wound on left hand beside base of left thumb.

In such circumstances, keeping in view the specific allegation against the petitioners of assaulting the informant and his wife, this Court is not inclined to grant anticipatory bail to the petitioners.

Prayer for anticipatory bail of the petitioners stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
