Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)a, 26 II, 35 of the Arms Act as well as Sections 8(c), 20(b)(1)B of N. D. P. S. Act.

Prosecution claims that petitioner and some others had assembled to make preparation for committing dacoity but according to the prosecution case itself, only one mobile phone was recovered from conscious possession of the petitioner. Petitioner does not have any criminal antecedent and moreover, having more or less, similar allegation, some co-accused have already been granted privilege of bail.

Accordingly, Petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Hajipur, Vaishali in connection with Mahua P.
