The petitioner seeks bail in connection with Mohania P.S. Case No. 227 of 2013 for the offences punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code & Sec. 27 of Arms Act.
The petitioner wants to renew the prayer of pre-arrest bail, which was earlier rejected vide order dated 15.01.2015 on the ground that no sharp cut injury has been found on the person of the informant and only lacerated red wound, measuring 1/2" x 1/4" x 1/4" on scalp, was found for which the petitioner has been alleged to be responsible and, as such, the petitioner deserves
Patna High Court Cr.Misc. No.54861 of 2015 (2) dt.16-12-2015 2/2 sympathetic consideration, to which the learned APP opposes. In the facts and circumstances stated above, considering that on the head, injury has been found by the doctor, caused by hard and blunt substance and, as such, finding no good ground for re-consideration of prayer of bail again the prayer of pre-arrest bail of the petitioner stands rejected. However, in case and if so advised, the petitioner surrenders and seeks regular bail, then his prayer for regular bail shall be considered on the same date without being prejudiced by the order of this Court.
