JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-09-2020 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mrs. Renu Kumari, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Rupaspur P.S. Case No. 76 of 2019 registered for the offence punishable under Section 306 / 34 of the Indian Penal Code, 1860 .

The allegation against the petitioner as per the First Information Report is that the marriage of the sister of the informant was solemnized with the brother of the petitioner namely, Shrawan Singh. It has further been alleged that after marriage, the sister of the informant was blessed with one son and one daughter from the wed lock and for the last one year

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. Learned counsel referring to Annexure - 2 to this petition submits that about 4-5 years back the deceased had met with an accident for which an F.I.R. was lodged in Delhi where the deceased was residing with her husband. Learned counsel referring to Annexure- 3 to this bail application submits that due to the said accident the deceased developed some neurological disease for which she was being treated at Delhi as well as at Patna.

Learned counsel further submits that petitioner is the brother- in- law of the deceased and she may have committed suicide due to her prolonged illness. Learned counsel further submits that petitioner is in custody since 30.04.2020. Having regard to the submissions made by the parties, taking into consideration the materials available on record and the fact that petitioner is in custody since 30.04.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs.
