The petitioner apprehends his arrest in Jandaha P.S. Case No.111 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The police intercepted a Maruti bearing registration No.BR31M-6268 and also apprehended one person namely Umanath Bharti. On search, 31 liters of Indian made foreign liquor was recovered. Umananth Bharti, the apprehended accused disclosed the name of two persons who managed to flee away. One of them is the petitioner, Prince Kumar and another is Ratnesh Bharti.

The learned counsel for the petitioner submits that Ratnesh Bharti has already been granted anticipatory bail vide

Patna High Court CR. MISC. No.23810 of 2019(2) dt.12-04-2019 2/2 order dated 02.08.2018 passed in Cr. Misc. No.46733 of 2018. The case of the petitioner stands on the same footing as nothing has been recovered from the possession of the petitioner. Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Vaishali at Hajipur in connection with Jandaha P.S. Case No.111 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
