====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 11-01-2021 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Dhanaha P.S. Case No. 152 of 2019 registered for the offences punishable under Sections 115, 147, 149, 323, 341, 342, 353 of the Indian Penal Code.

As per the prosecution case, on 01.09.2019 at about 10:02 hours, informant got information that 300 persons have apprehended one person telling as Dhakoshwa (child lifter). It is further alleged that the accused persons also used criminal force. Learned counsel for the petitioners submits that there is general and omnibus allegation. Altogether 16 persons have

Patna High Court CR. MISC. No.27182 of 2020(3) dt.11-01-2021 2/2 been named in the F.I.R. Petitioners are, though, named in the F.I.R. but carry no specific allegation. Petitioners have got clean antecedent as stted in paragraph-3 of the bail petition. He further submits that similarly situated co-accused has been granted bail by this Co-ordinate Bench of this Court vide order dated 05.01.2021 passed in Cr. Misc. No.29121 of 2020. Learned A.P.P. for the State has opposed the prayer for bail.

In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Begaha (West Champaran) in connection with Dhanaha P.S. Case No. 152 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
