JUSTICE SATYAVRAT VERMA ORAL ORDER 24-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Singheshwar P.S. Case No. 16 of 2020 instituted for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.12.2020 and has antecedent of two cases as mentioned in the supplementary affidavit and charge sheet has been submitted.

Allegation is of looting money from the informant by the five named persons along with unknown criminal who even assaulted Abdul Rashid on his forehead by butt of the pistol. Learned counsel for the petitioner submits that FIR is

Patna High Court CR. MISC. No.34724 of 2021(4) dt.24-01-2022 2/2 against unknown and the petitioner has been falsely implicated based on the confessional statement of co-accused Sahabuddin and petitioner is a handicapped person and nothing has been recovered from his possession.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and name of the petitioner transpired in the confessional statement of co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S.
