The petitioners are apprehending arrest in a case registered for the offences punishable under sections 323, 324, 307, 341/34 of the Indian Penal Code.
The accusation is of making assault to the informant, his son and wife. Though one of the injury has been found to be grievous whereas other injuries are simple in nature. It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. At earlier point of time, petitioner's side has lodged Chanan P.S. Case No.96/2015 against the informant, levelling
Patna High Court Cr.Misc. No.55454 of 2015 (2) dt.17-12-2015 2/2 accusation under sections 341, 323, 324, 307/34 of the Indian Penal Code. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Chanan P.S. Case No.95/2015, pending before the learned CJM, Lakhisarai.
With the above observation, this application is, accordingly, disposed off.
