====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 19-03-2025 With the consent of the parties, the present writ petition is heard and being disposed off at the "Admission" stage itself.

2. The petitioner, who superannuated from the post of Store Keeper on 31.01.2017 from Maharaja College, Ara under Veer Kunwar Singh University, Ara has approached this Court for the following reliefs:

"i. For that the basic pension of the petitioner may be fixed Rs. 35,000 /- in place of Rs. 20,895/- on the basis of 7th pay scale as fixed by the University on 2.2.2021.

ii. For that the respondent

Patna High Court CWJC No.7343 of 2024(2) dt.19-03-2025 2/3 authorities may be Commanded to make payment of the arrears of difference of pension, difference of Salary, rest amount of gratuity and rest amount of Earned Leave which are as follows

1. Arrears of difference of Pension Rs.

(a) February, 2017 to March, 2017 24,780/- (b) April, 2017 to March, 2019- 4,32,299/- (c) April, 2019 to Feb, 2024- 10,64,936/-

2. Arrears of difference of Salary From 1.4.1997 to January, 2017 - 18,54,845/-

3. Arrears of Gratuity 4,28,924/-

4. Arrears of Earned Leave - 2,65,690/- ---------- Total :-- 40,71,474/- (Rs. Forty lakhs Seventy one thousand four Hundred and Seventy four.) iii. For that the respondent authorities may also be directed to make 12% interest per annum for delayed payment on arrears as mentioned above.

iv. For that any other relief/reliefs may be granted to the petitioner for which he may be deemed entitled."

Learned Advocate for the petitioner contended that notwithstanding the superannuation of the petitioner long back in the year 2017, the petitioner has not accorded all his admissible retiral dues/benefits, as has been stated hereinabove. With respect to aforesaid claim, the petitioner has also approached before the Registrar, Veer Kunwar Singh University, Ara by filing a representation on 13.03.2024, which was duly received in the office, but till date, nothing has been done,

4. Learned Advocate for the University has submitted that since the representation of the petitioner is pending consideration before the Registrar, Veer Kunwar Singh University, Ara the writ petition may be disposed off.

5. In view of the aforesaid facts, the present writ petition stands disposed off with a direction to the Registrar, Veer Kunwar Singh University, Ara to consider the claim of the petitioner, as narrated in the representation of the petitioner, contained in Annexure-P/5 and pass a reasoned and speaking order, preferably within a period of eight weeks, from the date of receipt/production of a copy of this order.

6. Suffice it to observe that in case, the claim of the petitioner finds favour, all the necessary monetary benefits must be accorded to him within the stipulated period. (Harish Kumar, J) shivank/- U
