The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302, 404/34 of the Indian Penal Code and 27(3) of the Arms Act.

The prosecution case is that co-accused Manoj Rai, Bipin Rai and Ashok Rai @ Bachchu Rai fired upon the son of the informant. It is alleged against the petitioners that they assaulted the son of the informant with sickle. It is submitted by learned counsel for the petitioners that incised injury has been found on non-vital part of

Patna High Court Cr.Misc. No.53624 of 2015 (2) dt.26-11-2015 2/2 the body. The petitioners have been roped in since they are father and brother of the witnesses who deposed against the informant in Ganga Bridge P.S. Case No. 78 of 2013 and petitioners have no criminal antecedent. Statement to that effect has been made in paragraph 3 of the petition. Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Ganga Bridge P.S. Case No. 34 of 2015 pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.

With the aforesaid observation, this application is disposed of.
