The petitioner seeks bail in connection with Kishanganj P.S. Case No. 653 of 2018 instituted for the offence under Section(s) 376/313/201/120B of the Indian Penal Code. Learned counsel for petitioner has submitted that there is no any specific allegation of overt act against this petitioner in the written report.
It is alleged in the written report that Sarfaraz came to her house and on the point of knife committed rape with her and also made nude photographs by his mobile. He established relationship with her on the allurement of marriage on account of which she became pregnant. Thereafter, petitioner refused to perform marriage with the informant. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 653 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner.
