JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsel for the petitioner, learned counsel for the State, learned counsel for the informant. The petitioner seeks pre-arrest bail in connection with Sitamarhi P. S. Case No. 407 of 2015 registered under Sections 406, 420, 467, 468, 471 and 120 B of the Indian Penal Code. It is contended that the allegations made in the FIR are false and concocted. The petitioner did not manipulate or fabricate any government record. He had joined in Dumra Circle Office as revenue clerk on 27th October, 2015, whereas, corrections were made in the revenue records till 08.02.2014 pursuant to an order passed by the Additional Collector, Sitamarhi in Case No. 8525 of 2013-14. The rent was fixed in favour of the co-accused in

Learned counsel for the informant has contested the matter and opposed the application filed on behalf of the petitioner for grant of anticipatory bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Sitamarhi P. S. Case No. 407 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
