2. The petitioner seeks bail in connection with Garkha P.S. Case No. 808/2024 registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 103(1) and 74 of B.N.S.

3. As per the prosecution case, 16 FIR named accused persons including the petitioner are alleged of killing the deceased.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. It is next submitted that in the trial two witnesses have been examined and both of them have not supported the prosecution. Learned counsel further submits that he has no criminal antecedent and

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner and submitted that petitioner is the assailant of the deceased and he is said to have strangulated the deceased as it is evident from the post-mortem report.

6. Considering the gravity of the offence as well as in light of the judgment of the Hon'ble Supreme Court in the case of X vs. State of Rajasthan & Anr. reported as 2024 SCC OnLine SC 3539, this Court is not inclined to grant bail to the petitioner.
