JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-11-2020 Heard Mr. Sunil Kumar, learned counsel for the petitioner and Dr. Kumar Uday Pratap, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner seeks regular bail in connection with Parasi PS Case No. 56/2019 registered for the offence punishable under Sections 341, 323, 307, 504, 506/34 and subsequently, Section 302 of the IPC was also added.

3. The allegation, as per First Information Report, is that the petitioner as well as other accused persons caught hold of son of the informant and one co-accused, Shiv Sharan Chaudhary gave an axe blow on the head of the son of the informant, due to which, he died in the hospital during course of treatment after eight days.

Learned counsel for the petitioner submits that from perusal of the first information report, it would be evident that there is no allegation of assault upon the petitioner and the petitioner has allegedly caught hold of the son of the informant along with one another accused person. Learned counsel for the petitioner further submits that both the parties are co-villagers and there is land dispute between Shiv Sharan Chaudhary and the informant. Learned counsel also submits that petitioner has falsely been implicated in this case with oblique motive and he is in custody since 15.05.2020.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that there is no allegation of assault against the petitioner and he is in custody since 15.05.2020, I am inclined to grant regular bail to the petitioner subject to the conditions that

(1) the petitioner will fully co-operate with the investigation/trial of the case, failing which, the learned court below shall be at liberty to cancel the bail bond of the petitioner,

(2) petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.

6. Accordingly, let the petitioner, RANJEET

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of social distancing.
