JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 25(1-B) a, 26 of the Arms Act.
The prosecution case as per F.I.R is that on getting information that miscreants have assembled to commit some crime, raid was laid and four persons were arrested from whom, country made pistols, live cartridges, Charas, motorcycles etc were recovered.
Patna High Court CR. MISC. No.26945 of 2023(2) dt.24-05-2023 2/3 They disclosed the name of the petitioner as their associate who fled away from the place of seizure. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the place of seizure, or the apprehended accused persons or the seized articles. The petitioner is languishing in custody since 06.08.2022. Moreover, co-accused Santosh Kumar has been granted bail by a coordinate Bench of this Court vide order dated 04.03.2023 passed in Cr. Misc. No. 1417 of 2023.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District &
