JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 489(B), 489 C/34 of the Indian Penal Code and Sections 16, 17 of U.A.P. Act, 1967. Earlier the prayer for bail of the petitioner was rejected by this court taking note of this fact that near about rupees one lac counterfeit notes were recovered from conscious possession of the petitioner but submission on behalf of the petitioner is that having similar allegation, co-accused, Parasnath Chaubey has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 24.05.2016 passed in Cr. Misc. No. 9507 of 2016. It is further submitted that aforesaid co-accused, Parasnath Chaubey had criminal antecedent

Patna High Court Cr.Misc. No.37521 of 2016 (2) dt.28-09-2016 2/2 of similar nature but so far as petitioner is concerned, he does not have any criminal antecedent.

No doubt, co-accused, Parasnath Chaubey, having more or less similar allegation, has been granted privilege of bail but in my view, it is a serious case of use of counterfeit notes and, therefore, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with A.T.S. P.S. Case No. 02 of 2015 pending in the court of Chief Judicial Magistrate, Patna is again rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
