The petitioner seeks bail in Marhowrah P.S. Case No. 130 of 2019, registered for the offence under Sections 188/120(B)/34 of the I.P.C. and Sections 30/38/41 of Bihar Prohibition and Excise Act.

Total 1865 liters & 200 ml. of illicit foreign liquor has been recovered from a truck and it is alleged that seized consignment of liquor was brought by this petitioner and other co-accused persons.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the truck in question. Petitioner is in custody since 21.01.2021. Investigation is complete.

Patna High Court CR. MISC. No.35205 of 2021(2) dt.08-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Saran at Chapra in connection with Marhowrah P.S. Case No. 130 of 2019.
