This application is for grant of anticipatory bail in connection with Araria (Mahila) Police Station Case No.95 of 2016 for the offence under Section 376 of the Indian Penal Code. It is submitted on behalf of the petitioners that there is no specific allegation against the petitioner and the only allegation against this petitioner is that a Panchayati was held and it was decided that the son of the petitioner will marry the victim girl but the petitioner is not ready to get married his son and demanding dowry, this shows that the whole allegation has been made against the petitioner with a view to put pressure on him to get his marriage solemnized with the daughter of petitioner. It is also submitted by the petitioner that whatever allegation is there
that is against son of the petitioner. It is further submitted that earlier the petitioner had also lodged a case against the informant and the family members stating that they are threatening him to get his son married with the daughter of the informant. Heard learned A.P.P. also.
Having heard both sides. In view of the fact that there is no allegation against the petitioner about rape and main allegation is against his son, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Araria in connection with Araria (Mahila) Police Station Case No.95 of 2016 , subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with a condition that he will cooperation in the investigation of the case and make available himself as and when required.
Accordingly, this application is allowed.
