JUSTICE BIRENDRA KUMAR ORAL ORDER 27-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

There is allegation of defalcation of public money which was meant for construction of class room. Submission of the petitioner is that, on the protest, the petitioner is ready to refund the alleged amount and 50% of the same would be deposited before filing of the bail bond and the supporting document would be produced thereat and the remaining 50% shall be deposited within further six months. Considering the aforesaid undertaking, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.50619 of 2016 (4) dt.27-01-2017 2/2 before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger/Successor Court in connection with Kotwali Police Station Case No. 211 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
