2. The petitioners apprehend arrest in Sugauli P.S. Case No. 530 of 2023, registered under Sections 302, 201, 120B and 34 of the Indian Penal Code.

3. The prosecution case, in short, is that, daughter of the informant was married with co-accused Govinda Ram and it is alleged that the petitioners along with other co-accused persons including the husband of the deceased have killed the daughter of the informant and cremated her body.

4. Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in the present case. Petitioner no. 1 is father-in-law and petitioner no. 2

Patna High Court CR. MISC. No.31145 of 2024(3) dt.10-07-2024 2/2 is devar of the deceased and they are separate in mess and business from the husband of the deceased. It is also submitted that there is no specific allegation levelled against the petitioners. The petitioners have got no criminal antecedent. Learned counsel for the petitioners further submits that similarly situated co-accused has been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 12.03.2024 passed in Cr. Misc. No. 19444 of 2024.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances, let the petitioners, above named in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sugauli P.S. Case No. 530 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Rudra Prakash Mishra, J) Rajorshi/- U T
