JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Chowk P.S. Case no. 27 of 2016, registered under Sections 419, 420, 467, 468, 471, 472, 475, 476 & 504/34 of the Indian Penal Code. The prosecution case is that on seeing the advertisement for job in Telenor Company, the informant contacted with petitioners on Mobile No. 7274030959, which was given on the said advertisement pasted on the wall. Then he was called by a boy, who disclosed his name as Vishal @ Chhotu (Petitioner No.3) and he gave his address of the office near Patna Saheb Station. On 28.08.2015, informant reached in the said office where petitioner Vishal Kumar @ Chhotu along with Manish Kumar Yadav, Priya, Ankit were present in

No.44358 of 2016 (2) dt.22-10-2016 2/2 the office, they verified the certificates and also asked questions in the interview and informed that informant could not succeed in the interview and call him to provide Rs. 5,000/- for job as donation. The informant handed over Rs. 10,000/- and one Suraj has also given Rs. 15,000/- out of which Rs. 7000/- was deposited in the account of Sarvesh Kumar, but till date job has not been provided to him. Learned counsel for the petitioners submits that there is allegations against the petitioners that they are only present in the said office. Moreover, the petitioners have no criminal antecedent and similarly situated co-accused Manish Kumar has already been granted Anticipatory Bail on 09.09.2016 passed in Criminal Miscellaneous No. 37566 of 2016.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City in connection with Chowk P.S. Case No. 27 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
