JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-09-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Jagdishpur Police Station Case No. 106 of 2017, disclosing offences under Sections 147, 149, 420, 353 and 188 of the Indian Penal Code and Section 171(A), 171(H), 1714(F) of R.P. Act.

Learned counsel for the petitioners has submitted the petitioner, who is of clean antecedent, is innocent and has not committed any offence. As a matter of fact, the petitioner had filed his nomination for the election of Ward Parishad under Nagar Panchayat, Jagdishpur thereafter informant try to put pressure on him to withdraw his nomination but on refusal of the

Patna High Court Cr.Misc. No.39872 of 2017 (2) dt.21-09-2017 same, informant himself assaulted and abuse the petitioner and forcibly taken his signature on the blank paper. In this regard, the petitioner has informed to the S.P. and D.M, Bhojpur, which is evident from annexure-3 and 4. The petitioner has also filed a complaint Case No. 53(C) of2017 against the informant and others and account of that only, this petitioner has falsely been implicated in this case. Hence, the petitioner deserved the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Bhojpur, in connection with Jagdishpur Police Station Case No. 106 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
