Petitioner is apprehending his arrest in a case registered for offences punishable under Section 409 of the Indian Penal Code. The allegation against the petitioner is that in spite of instruction by the District Education Officer, Rohtas, the petitioner has not submitted the document relating to appointment of Panchayat Teachers at Block Resource Centre, Dehri till 02.03.2016.
It has been submitted on behalf of the petitioner that he could not submit the required documents relating to appointment of Panchayat Teachers till 02.03.2016, but just after two days i.e. on 04.03.2016, he has submitted the required documents. It has

No.50990 of 2016 (3) dt.19-12-2016 2/2 further been submitted that on similar allegation, a case bearing Dihri (Indirapuri) P.S. case was instituted against the petitioner, in which he has been granted the privilege of anticipatory bail by this Court vide order, date 24.11.2016, passed in Criminal Miscellaneous No. 50299 of 2016.
Having heard both sides and in view of the fact that the petitioner having similar allegation, has been granted the privilege of anticipatory bail in another case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dihri-on-Sone, in connection with Darihat P.S. Case No. 18 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
