The petitioner being the mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
Accusation is of killing the daughter of the informant after three years of marriage for non-fulfillment of dowry demand.
It is submitted by the learned counsel for the petitioner that love marriage was performed between deceased and her husband and there is no question of demand of dowry. The petitioner claims to be separate from the husband of the victim. The thrust of accusation is against husband of the victim.
Patna High Court Cr.Misc. No.56776 of 2015 (2) dt.15-12-2015 Considering the thrust of accusation is against husband of the victim, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 342 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
