JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Section 47 (a) (f) of the Bihar Excise Act, 2015.

It is alleged that on the basis of confidential information, the informant along with other excise officials recovered 20 liters of illicit country made liquor kept in a plastic gallon and 2000 kg. of Jawa Mahua from illegal wine manufacturing Adda. On seeing the police party the petitioner fled away.

In this manner, from the written report itself it appears that nothing has been recovered from the conscious possession of the petitioner. The copy of the seizure list was

It has further been submitted that one of the co-accused has been granted bail by a coordinate Bench of this Court vide order dated 10.1.2017 passed in Cr. Misc. 317 of 2017.

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with G.O. Case No. 44 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
