JUSTICE ANIL KUMAR SINHA ORAL ORDER 02-08-2019 The petitioners apprehend their arrest in connection with Complaint Case No. 1411 of 2018 in which cognizance under Sections 307, 323 and 341/34 of the Indian Penal Code has been taken.

Allegation against the petitioners, as per complaint case is that petitioner no. 1 is father and petitioner no. 2 is step mother of the complainant and they along with step maternal uncle of the complainant assaulted the complainant on his chest, stomach and ear and further tried to kill his after pressing his neck. Learned counsel appearing on behalf of the petitioners submits that present complaint has been lodged by the

Patna High Court CR. MISC. No.24759 of 2019(7) dt.02-08-2019 2/2 complainant with concocted story at the behest of somebody else against the petitioners. Learned counsel submits that no injury has been found on the person of the complainant as the present complaint has been filed with oblique motive. Despite service of notice, nobody appears on behalf of the O.P.No. 2.

After having heard learned counsel for the parties and taking into consideration the fact that no injury has been found on the person of the complainant and further petitioner no. 1 is father of the complainant, as such I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Patna City in connection with Complaint Case No. 1411 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
