JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2017 The petitioner is apprehending his arrest in connection with Raniganj P.S. Case No. 70 of 2016, registered for offences punishable under Sections 409 and 420 of Indian Penal Code. It has been submitted on behalf of the petitioner that he happens to be the secretary of the school and he is not directly connected with the construction of the building of the school, however he was given the cheque of Rs. 7,00,000/-. Further the petitioner being a lady and undertakes to complete the remaining construction work, she may be allowed the privilege of bail. Heard learned A.P.P. also.

Having heard both sides, in view of the fact that the petitioner is a lady and she also undertakes to complete the remaining construction of work, let the petitioner above named, in

No.54780 of 2016 (2) dt.31-01-2017 2/2 the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on provisional bail till submission of charge-sheet in this case, on furnishing bond of Rs. 25,000/- (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria, in connection with Raniganj P.S. Case No. 70 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. It is made clear that once the charge-sheet is filed in the present case, the petitioner will have to surrender before the court below and if so desire, may make a prayer for regular bail, which will be considered by the learned court below on the materials available before him at that point of time and also consider the progress of work if any at that time.

With the above observation, this application is disposed of.
