The petitioner is apprehending his arrest in a case registered under Sections 323, 354 and 379/34 of the Indian Penal Code.

Allegation against the petitioner is that he caught the hand of the wife of brother of the informant with bad intention and outraged her modesty.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the parties. The occurrence is said

Patna High Court Cr.Misc. No.305 of 2017 (2) dt.11-01-2017 2/2 to have taken place due to land dispute in which free fight had taken place between the parties. The land in question belongs to the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ram Jha, J.M. 1st class, Katihar in connection with C.A. case No.2279 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
