The petitioner seeks pre-arrest bail in connection with Sonbarsa Raj (Kashinagar O.P.) P.S. Case No.239 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

Regard being had to the gravity of the offence and the fact that the name of the petitioner transpired in course of investigation and the police may require his custodial interrogation as also the fact that two other accused, namely, Shivnandan Singh @ Shivo Singh and Halo Mahto @ Halo Singh have not been granted pre-arrest bail by a Bench of this Court despite the fact that after noticing the fact that other co-accused persons, namely, Baleshwar Mahto @ Rajeshwar Mahto and Khushilal Mahto @

Patna High Court Cr.Misc. No.11681 of 2018 (2) dt.27-02-2018 2/2 Khushilal Mandal have been granted pre-arrest bail by a Bench of this Court, I am not inclined to grant pre-arrest bail to the petitioner.

Accordingly, the application for grant of pre-arrest bail is rejected.

In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
