The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 354, 504, 506 of the Indian Penal Code.

Prosecution case as lodged by the informant is that when he was teaching in his school with one Chandrakant Kumar in the meantime, Ranjeet Kumar abused Geeta Devi who is appointed to prepare meal. Informant tried to pacify the matter then petitioner pulled the saree of Geeta Devi and also assaulted with the first and slaps and thrown on the ground. It is alleged that petitioner was in drunken condition. When the villagers assembled, then he fled away after giving threatening him.

Patna High Court CR. MISC. No.27163 of 2020(3) dt.15-01-2021 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. He submits that allegation made in the FIR is false and concocted. More over allegation of assault is vague and general. No case of Section 354 IPC is made out against the petitioner. He submits that injury found upon the victim is simple in nature. He further submits that petitioner bears no criminal antecedent as stated in para-3 of the bail application.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Ghoshi (Okari) Police Station Case No. 448 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
