JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,342,323,325,379,504 and 307/34 of the Indian Penal Code. The prosecution case is that the brother of the informant was kidnapped by the accused persons for getting the cases lodged against them. It is alleged that the brother of the informant was assaulted when wife and elder sister in law came to rescue then their ornaments were snatched and assaulted. It is further alleged that the petitioner took out eighty thousand rupees from the brother of the informant.

It is submitted by the learned counsel for the petitioner that for the petty dispute the accusation has been levelled. The

Patna High Court Cr.Misc. No.54127 of 2015 (2) dt.30-11-2015 2/2 accusation of assault is omnibus and general and no recovery has been made from the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, similarly situated co accused Praveen Kumar has been granted anticipatory bail vide Cr. Misc. No. 27394 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gaya in connection with Wazirganj P.S. Case No. 71 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
