The petitioner seeks bail in a case registered under Sections 384, 386, 387 of the Indian Penal Code and Sections 27 of the Arms Act.

The prosecution case in short is that the petitioner along with other accused persons assaulted the informant with Lathi and also, fired upon the informant. The informant sustained injury. There is allegation of demanding ransom of Rs. 50,000/- It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 06-11-2018. Charge sheet in this case has already been submitted. The

Patna High Court CR. MISC. No.31223 of 2019(2) dt.10-05-2019 2/2 petitioner and the informant are co-villagers. Due to previous enmity, present case has been instituted. It has further been submitted that the petitioner may be released after completion of nine months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. The petitioner has got six criminal cases pending against him.

Considering the aforesaid facts and circumstances, it is directed that after completion of nine months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri M. Kumar, learned Judicial Magistrate-Ist Class, Barh (District-Patna) in connection with Mokama P.S. Case No. 249 of 2018. (Sudhir Singh, J) A.K.V.//- U T
