JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-10-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 304B of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have killed the daughter of informant by setting her on fire. Petitioner is husband of the deceased.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that both the husband and the wife were living happily for more than 10 years and having three children and none of the witnesses have alleged anything about demand of dowry or torture to the deceased by this petitioner. Patna High Court CR. MISC. No.35046 of 2021(3) dt.25-10-2021 2/2 further submitted that daughter of informant disclosed about the occurrence but her statement was not recorded. Petitioner is in custody since 11.11.2020 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that there is specific allegation against this petitioner that he poured kerosene oil and set the deceased on fire as a result of which she died due to burn injuries.

Considering the facts of the case and the nature of accusation made against this petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. However, since the petitioner is in custody since 11.11.2020, the trial court is directed to conclude the trial as early as possible.
