2. The petitioner seeks bail in connection with Naubatpur P.S. Case No. 97 of 2024 registered for the offences under Sections 302, 201, 120 (B) and 34 of the IPC.

3. The petitioner is not named in the F.I.R. and is in custody since 26.09.2024.

4. The allegation against the petitioner is to commit the murder of husband of the informant along with other named co-accused persons due to property dispute.

5. Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner transpired in

No.24997 of 2025(3) dt.28-07-2025 2/3 the present case during the course of investigation on the basis of confessional statement of apprehended co-accused person namely Lal Bahadur Singh @ Bahadur, in furtherance of which no incriminating material recovered/surfaced so as to connect petitioner prima-facie with the present occurrence of murder. While concluding the argument it is submitted that petitioner found involved in one more case of petty nature, where he is on bail and moreover, investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

7. In view of aforesaid facts and circumstances as mentioned above and by taking note of fact as prima-facie save and except suspicion arising out of confessional statement of co-accused, nothing incriminating appears against this petitioner, coupled with the fact as petitioner is in custody since 26.09.2024, accordingly above named petitioner, is directed to be released on bail in connection with Naubatpur P.S. Case No. 97 of 2024 on furnishing bail bond
