JUSTICE SHIVAJI PANDEY ORAL ORDER 16-04-2018 Learned counsel for the petitioners submits that the petitioner no.1 has already been arrested by the police. In that view of the matter, this order is confined only to the petitioner nos. 2 & 3 respectively.
Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are apprehending their arrest in connection with Gogri P.S. Case No. 522 of 2017 registered for offences under sections 341, 323, 504, 120(B)/34 of the Indian Penal Code and Sections 25(1-AA), 26/35 of the Arms Act.
In the First Information Report, an allegation has
Patna High Court Cr.Misc. No.9076 of 2018(4) dt.16-04-2018 2/2 been made by the Informant that he was intercepted and assaulted and the accused persons have planted the pistol in his pocket.
Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioners at this stage. Accordingly, the prayer for anticipatory bail of the petitioners, namely, Madhu Yadav @ Madha Yadav and Fantus Yadav is rejected.
If the petitioners surrender before the court below within a period of three weeks from today, the court below, without being prejudiced by this order, will take a decision in accordance with law.
