JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Udwantnagar P.S. Case No. 166 of 2017, registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that when the nephew and grandson of the informant had gone to graze buffalo in the filed then five persons named in the F.I.R. including the petitioner having armed with gun started to cause injury to them. When the informant and others rushed to save them then all started to abuse and made

Patna High Court Cr.Misc. No.39126 of 2017 (4) dt.12-12-2017 firing. In the firing of Satendra Yadav, informant Jai Ram Singh, Baliram Yadav and Shanti Devi sustained pellet injury. Learned counsel for the petitioners submits that, in fact, occurrence took place due to land dispute while petitioners are named in the F.I.R., but the specific overt act has been attributed against Satendra Yadav to open fire causing injury to informant, Baliram Yadav and Shanti Devi.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Udwantnagar P.S. Case No. 166 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
