Patna High Court CWJC No.20077 of 2013 (2) dt.11-04-2016 2/2 Commission are present.
The petitioner is aggrieved by the dismissal of the election petition bearing Election Petition No. 1 of 2011 vide judgment and order dated 22.4.2013 passed by the Munsif, Patna-cum-Election Tribunal. The challenge to the election is on the basis of alleged wrongful counting and the court below examining the issues threadbare has found no infirmity in the same. Considering that there is a concurrent findings of fact on the issue of counting, I am not persuaded to interfere with the opinion expressed by the Election Tribunal. Further after announcement of the fresh Panchayat Election, 2016, the issue raised has become academic. The writ petition is accordingly disposed of. (Jyoti Saran, J) Bibhash/- U
