JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bochaha P.S. Case No. 281 of 2014 registered under Section 302/120(B) of the Indian Penal Code and 3(2) (v) of the S/C and S/T (prevention of atrocities) Act.

The allegation of informant Prabhakar Murti is that marriage of Khushboo Kumari, daughter of brother-in-law, was performed with Pawan Kumar Singh and she had two sons and was doing the job in Primary Health Centre at Bochaha. Since Pawant Kumar used to torture her, as she belongs to Scheduled Caste. Pawan Kumar had married earlier three times but left them and performed again marriage with Khushboo Kumari only to

On 10.10.2014, Khushboo Kumari was killed by pressing her neck through rope by Pawan Kumar and thereafter, he left the house. In murder, in addition to Paswan Kumar, his lover, his parents and petitioner, who was doing work in Krishna Sweets House of Pawan Kumar, were involved. Learned counsel appearing on behalf of the petitioner submits that in fact, petitioner has no concern with the family of Pawan Kumar, nor any manner related to his lovers and mere on suspicion, the informant, who is uncle (Mausa) of the deceased, has implicated this petitioner.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Muzaffarpur in connection with Bochaha P.S. Case No. 281 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C. Out of two sureties, one surety must be parent/co-relative of the petitioner, who will file an affidavit showing his relation with this petitioner. (Rajendra Kumar Mishra, J.) Shail/- U T
