The petitioner is in custody in connection with Singhwara P.S. Case No.22 of 2020 registered for the offence under Sections 406, 420, 467, 468, 120B of IPC and Section 138 of N.I. Act.
Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. A complaint was filed by the informant before the learned Chief Judicial Magistrate, Darbhanga which was transferred to the police under Section 156 (3) Cr.P.C and the case was registered with regard to dishonor of four cheques of Rs. 52,24,000/-. It is alleged that petitioner has committed
Patna High Court CR. MISC. No.24819 of 2020(2) dt.24-09-2020 2/2 embezzlement while working as Assistant Manager in the agency. The petitioner is in custody since 20.03.2020. Considering the fact that essentially the dispute pertains to accounting and dishonor of cheques, the Court is inclined to grant bail to the petitioner.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Darbhanga, in connection with Singhwara P.S. Case No.22 of 2020. Grant of bail to the petitioner shall not cause prejudice to the informant in realizing the alleged amount by other legal means.
