This application for regular bail arises out of Hajipur Town P.S. Case No. 419/2020, disclosing commission of offences punishable under Sections 399/402 of the Indian Penal Code, Sections 25(1-b) a/26/35 of the Arms Act and Sections 20/22/23/24/27(A)/29 of N.D.P.S. Act.

The petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 07.04.2022 passed in Cr.Misc. No. 63774 of 2021, taking into account the provision under Section 37 of the N.D.P.S. Act. By making this application, the petitioner has renewed his prayer for regular bail.

Patna High Court CR. MISC. No.29157 of 2023(2) dt.03-05-2023 2/2 Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has remained in custody since 01.07.2020 and there is no substantial progress at the trial. Considering the nature of accusation and the statutory provision under Section 37 of the N.D.P.S. Act, I am not inclined to reconsider the petitioner's prayer for grant of regular bail.

This application is accordingly dismissed. It is, however, observed that let the Court below take all possible measures to ensure that conclusion of trial of the case arising out of Hajipur Town P.S. Case No. 419 of 2020 is expedited. (Chakradhari Sharan Singh, J) Suraj/- U T
