Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioners seek anticipatory bail in connection with Rafiganj P.S. Case No. 181 of 2020, registered for the offences under Sections 341, 323, 504, 506, 354, 307, 498A/34 of the Indian Penal code.
The petitioners are brother-in-law (Bhaisur) and father-in- law of the informant. The allegation is of torture for dowry. Further allegation is of assault, as a result of which, the
Patna High Court CR. MISC. No.35094 of 2021(3) dt.30-03-2022 2/2 informant sustained some injury which includes minor fracture of thumb. In the opinion of this court, under Section 307 of Indian Penal Code is not made out. Hence this application for anticipatory bail is allowed.
Let the petitioners, above named, in the event of their arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Ld. Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 181 of 2020, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
