This application is for grant of regular bail in connection with Narpatganj P.S.Case no.395 of 2018for the offences under Sections 366(A) of the Indian Penal Code. Allegation against the petitioner is of kidnapping of the daughter of the informant.
Submission of the learned counsel for the petitioner is that there is delay in lodging the FIR and though she has stated of physical relationship in her statement recorded under Section 164 Cr.P.C. but the medical report does not support the same and he is in custody since 29.1.2019. Heard learned A.P.P. who has opposed the prayer for bail stating that the girl in her statement recorded under Section 164 Cr.P.C. has stated about kidnapping and rape

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.
With the aforesaid observation, this application is dismissed.
