2. The petitioner seeks bail in connection with Mahila P.S. Case No. 02 of 2024 registered for the offence under Section 341, 342, 323, 376, 504, 506, 120(B) of the Indian Penal Code.
3. From the contents of the FIR, it appears that the petitioner is a consenting party to her relationship with the informant.
4. The petitioner is in jail since 17.10.2024.
5. Learned counsel for the informant has opposed the application of the petitioner by submitting that the victim
Patna High Court CR. MISC. No.25089 of 2025(2) dt.01-05-2025 2/2 has been raped.
6. Considering the aforesaid facts, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Katihar/concerned Court below in connection with Mahila P.S. Case No. 02 of 2024.
8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
