The petitioner apprehends his arrest in connection with Siwaipatti P.S. Case No. 49/2017 registered for the offences punishable under Sections 147/148/149/341/323/324/307/506/379 and 385 of the Indian Penal Code.
Learned counsel for the petitioner submits that though there is allegation of attacking with farsa, there is no injury to support the said allegation. It is further submitted that there is case and counter case between the parties and the present First Information Report has been lodged after a delay of ten days for which no plausible explanation has been offered. Considering the entire facts and circumstance of the
Patna High Court Cr.Misc. No.16358 of 2018 (2) dt.05-04-2018 2/2 case and that the petitioner has no criminal antecedent, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Judge, 9th-cum-A.C.J.M., Muzaffarpur, in connection with Siwaipatti P.S. Case No. 49/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
