2. Petitioner seeks regular bail in connection with Nabinagar P.S. Case No. 129 of 2024 in a case registered for the offence punishable under Sections 30(a) and 30(C) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 115 litres country made liquor has been recovered from the bank of Sone river.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 26.11.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposes the
Patna High Court CR. MISC. No.27218 of 2025(2) dt.04-07-2025 2/2 bail application of the petitioner.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of District and Additional Sessions Judge cum Exclusive Special Judge, Excise Court No. 1, Aurangabad in connection with Nabinagar P.S. Case No. 129 of 2024.
