Petitioner apprehends his arrest in Akbarpur P.S. Case No.75 of 2018, registered under Sections 341, 323, 504, 506 and 34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The informant lodged the case that he saw 20 litres Mahua liquor in the wheat crop field of Krishna Ram, petitioner. Biru Yadav supplied the liquor to Krishna Ram. The liquor was seized by the police.
Learned counsel for the petitioner submits that the informant is next door neighbour of the petitioner, Krishna Ram. Biru Yadav has already been enlarged on bail. The recovery was made from wheat field of the petitioner.
Taking into consideration that the recovery was made
Patna High Court CR. MISC. No.24568 of 2019(2) dt.16-04-2019 2/2 from open field and the person, who is alleged to have supplied the liquor kept in the wheat field of the petitioner, has already been granted anticipatory bail, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IInd-cum-Special Judge, Nawada in connection with Akbarpur P.S. Case No.75 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
